April 29, 2011, Ottawa — More than 80,000 Ontario farm workers will find out today if they have the right to unionize.

April 29, 2011, Ottawa — More than 80,000 Ontario farm workers will find out today if they have the right to unionize.

The Supreme Court of Canada is to rule today on the constitutionality of an Ontario ban on farm unions. In November 2008, the Ontario Court of Appeal upheld a UFCW Canada charter challenge that the Ontario farm union ban was unconstitutional. The decision pointed to freedom of association rights to organize for the purposes of collective bargaining.

The Ontario government appealed the ruling to the Supreme Court of Canada, which heard arguments in December, 2009. If the court upholds the lower court ruling, the way would be open for Ontario agriculture workers to join unions and bargain collectively.

UFCW Canada represents more than 250,000 Canadian workers and has been advocating for farm worker’s rights for over two decades.
